Artificial Intelligence – Subject or Object of Law?

Abstract: It is stated that according to the Concept of the Development of Artificial Intelligence in Ukraine, the implementation of state policy in the field of artificial intelligence will affect the key interests of such stakeholders as citizens, educational institutions, business entities, executive authorities and local governments. And the implementation of the Concept itself will have a positive impact on Ukrainian business, state authorities, local governments and citizens in terms of creating a legal basis for the functioning of artificial intelligence technologies, determining the main areas of their application, the main directions of development and the rules for their application in each individual industry. In addition, the above will also contribute to the development of the scientific and technical component of domestic developments of artificial intelligence, and therefore, an increase in the number of Ukrainian technologies in the field of artificial intelligence, their entry into foreign markets. It is noted that currently artificial intelligence technologies penetrate most areas of human life, from everyday life to professional activities, and scientific research is no exception. Artificial intelligence provides numerous opportunities when preparing research and writing scientific articles. At the same time, the issue of the feasibility, even the need for legal regulation of the use of AI has a certain history and is associated with the development of automation of various processes that took place in the last century. Various definitions of AI have been given as a relevant technology, primarily based on machine learning algorithms and data analysis, that is constantly revolutionizing the research landscape and that continues to evolve, with the potential to accelerate the pace of scientific discovery and improve the quality of research results. AI has brought significant changes to the academic sphere, revolutionizing the ways in which research is conducted, knowledge is generated, and education is delivered. The integration of artificial intelligence technologies into the academic sphere has the potential to optimize processes, improve research outcomes, and foster innovation. It outlines trends, opportunities, and potential implications that the use of AI in academic research may have, as well as specific caveats regarding the use of AI in this area; it outlines the main stages of scientific research where AI can improve academic functions. An analysis of scientific research has been conducted in terms of approaches to determining the legal status of artificial intelligence, that is, its possible legal objectivity or legal personality, regarding the positive and negative argumentation of the above. It is argued that in order to deny the possible legal personality of AI, the following criteria are decisive for the above: man; society; ethics; morality; worldview; feelings; culture; consciousness, etc.; defining criteria that are inherent in man but absent in artificial intelligence are highlighted. The general conclusion is that AI is and should be further defined as an object of law, for the functioning of which its producer or owner (user) should be responsible. That is, AI is an object of law, to which the efforts, actions, controllability, use and responsibility for its functioning of a legal subject, which is a natural and legal person of society, are directed.
